The Relationship between the Constitution, the Branches of Government and the States.
In America the Constitution is the Supreme Law. Elected officials swear to uphhold it.
But it is only a piece of paper. For it to continue to Make America Great it must be followed and cherished by citizens, presidents, members of Congress. judges, and state governments.
Cleta Mitchell on Judicial Authority:
I spent weeks and months in the SCOTUS law library, studying the pre and early US Constitution documents, records, books, essays, preparing for the certain SCOTUS case involving congressional term limits. One historian I particularly loved was Bernard Bailyn. His writings and lectures about the formation of America’s founding are brilliant. In one lecture, he talked about Article III of the Constitution, the judiciary. And how Congress was given the pen to establish the inferior courts, and everything about them. Only the Supreme Court is described in the Constitution. There are very few Constitutional rules about the rest of the judiciary, the district and appellate courts.
Congress in the Judicial Act of 1789 established the rest of the Court system and its operations, structure, numbers; there have been multiple similar laws enacted since. Congress is supposed to oversee the judiciary. For example, Congress has ultimate authority over the federal Rules of Civil Procedure, the Rules of Evidence and the basic building blocks of the federal courts - including their jurisdiction.
What Congress has failed to do in any significant way since 1911 (when it passed the last major Judicial Act), is to exercise proper constitutional oversight of the judiciary. The Framers would be appalled at the brazen disregard of the limits on judicial power by the post-modern federal judges who are wielding a meat axe to the Constitution as envisioned and articulated in the Constitution.
Congress needs to dust off its long abandoned, long overlooked constitutional responsibility to oversee the Article III officers - and to so before these arrogant, self-aggrandizing presidential wannabe lawyers in black robes destroy the country.
Their power is subject to congressional limits, within the specific confines of the Constitution.
Congress: Do your job, oversee the Article III branch.
